Employment Law is Changing - The Vetting & Barring Scheme
The timeline below details all the changes that have and will be made and how they may affect your organisation. BACP will be holding an event later in the year to familiarise organisations with the new process and application form.

The POVA, POCA and List 99 have been replaced by two new lists:- The Children’s List Vulnerable Adults List The POVA First has been replaced with the ISA First but the service remains the same |

New employees or volunteers working with vulnerable groups must apply for an enhanced CRB check if they are working in regulated activities ie: Of a specified nature eg, teaching, training care, supervisions, advice, treatment or transport Or In a specified place eg, schools, children’s homes, hospitals, juvenile detention facilities or adult care homes Standard checks are still available but information will only be given which is held on the Police National Computer, the two lists will not be checked |

New employees/volunteers who will be working with vulnerable groups of a specified nature or in a specified place who have frequent contact ie, they work with children once a week or more OR have intensive contact with vulnerable groups ie. the work takes place on four days in one month or overnight will need ISA registration status |

From July 2010 onwards |
ISA registration will NOT replace the need for a CRB check. The CRB will continue to provide access to an individual’s full criminal record and other information to assess the suitability for a particular post or position |

For those already employed who work with vulnerable groups and already have a CRB check will need to apply for ISA registration throughout a five year rollout period, starting with those who have the oldest CRB check |

November 2010 |
A regulated activity provider or personnel supplier will be committing an offence if they fail to check if an individual is ISA registered and allow them to engage in regulated activity It will be a legal requirement for those working in regulated activity positions to be ISA registered in November 2010 if they are commencing new employment or changing roles. |
Additional points:
- Parents and friends making private arrangements regarding childcare will not need to register with the ISA
- ISA registration status will apply where organisations such as schools, clubs or groups make the decisions as to which adults should work with their children subject to the “frequent” and “intensive” definitions
- The “frequent” benchmark requires that the applicant will be work with children more than once a week.
- The “intensive” benchmark requires that the applicants work will take place on four days in one month or more or overnight.
- Individuals who go into different schools or similar settings to work with groups of children will not be required to register unless their contact with the same children is “frequent” or “intensive”.
- The minimum age or registration for young people engaged in regulated activity as part of their continuing education will be reviewed. 16-18 year olds in education do not require ISA registration.
- Overseas visitors bringing their own groups to the UK will have a 3 month exemption from the requirement to register for the work they do with children in the UK.
- Exchange visits lasting less than 28 days where overseas parent accept the responsibility for the selection of the host family will be regarded as private arrangements and will not need ISA registration.
